1. Purpose
This Policy establishes rules governing commercial communications, catalogs, Member messaging, AI-assisted content, automated marketing and business-development activities conducted through Beautynavigator.
It supplements the Beautynavigator Terms of Use and Privacy Policy.
2. Beautynavigator Communications
Beautynavigator may send communications relating to:
- account administration;
- security;
- transactions;
- requested services;
- platform functionality;
- business opportunities;
- marketing;
- catalogs;
- sourcing;
- auctions;
- reverse auctions; and
- other permitted B2B activities.
The legal treatment of a communication depends on its purpose and applicable law.
3. Marketing Eligibility
Before a marketing communication is sent, Beautynavigator may evaluate factors including:
- recipient jurisdiction;
- recipient type;
- corporate or individual status;
- generic or personal email address;
- source of information;
- applicable legal basis;
- prior consent;
- prior relationship;
- professional relevance;
- objection status;
- communication type; and
- other applicable legal or platform requirements.
Beautynavigator may prevent delivery where eligibility cannot be established with sufficient confidence.
4. Suppression and Do-Not-Contact Records
Beautynavigator may maintain a suppression database containing identifiers necessary to prevent future unwanted communications.
An opt-out or objection may be applied across applicable Beautynavigator marketing systems rather than merely to the particular campaign in which the objection was received.
Members may not circumvent Beautynavigator suppression controls.
5. Member Marketing
Members may be permitted to promote products, services, catalogs and commercial opportunities to other businesses through Beautynavigator.
Members must only use such tools for lawful business purposes.
Members may not use Beautynavigator to:
- send deceptive messages;
- conceal their identity;
- use misleading subject lines;
- distribute malicious content;
- repeatedly contact persons who have objected;
- promote unlawful goods or services;
- impersonate another business;
- misrepresent product claims; or
- otherwise violate applicable law.
6. Catalog Distribution
Members may authorize Beautynavigator to distribute approved catalogs to relevant businesses.
Beautynavigator may determine appropriate distribution channels, recipients, frequency and eligibility based on platform rules and applicable law.
Catalog distribution does not guarantee that a recipient will open, view, respond to or purchase from the catalog.
7. Internal Messaging
Beautynavigator may provide internal messaging that permits Members to communicate without exposing the recipient's underlying email address.
Beautynavigator may retain message metadata and other information necessary for security, abuse prevention and operation of the service.
Beautynavigator may limit messaging privileges for accounts generating complaints or suspected unlawful activity.
8. AI-Assisted Catalog Creation
AI tools may assist Members in creating catalogs and commercial materials.
Members must review information before publication when appropriate.
The Member is responsible for:
- product claims;
- pricing;
- availability;
- certifications;
- images;
- intellectual-property rights;
- regulatory claims;
- product descriptions; and
- compliance with applicable law.
Beautynavigator does not guarantee AI-generated information.
9. AI-Assisted Directory Enrichment
Beautynavigator may use automated and AI-assisted technologies to process business information obtained from lawful sources.
The purpose may include:
- identifying businesses;
- correcting errors;
- identifying duplicate records;
- categorizing companies;
- identifying products and services;
- enriching business profiles;
- identifying business relationships;
- improving search;
- improving recommendations; and
- maintaining directory quality.
Automated processing does not mean that every resulting data point is guaranteed to be correct.
10. Commercial Content Responsibility
The business promoting a product or service remains responsible for the legality and accuracy of its commercial content.
Beautynavigator does not independently endorse every Member claim.
Beautynavigator may remove or restrict content where it reasonably believes the content presents legal, safety, fraud, intellectual-property or reputational concerns.
11. Email Compliance
Commercial email sent through or by Beautynavigator must comply with applicable laws.
Depending on jurisdiction and recipient type, this may include requirements concerning:
- identification of the sender;
- accurate header information;
- truthful subject lines;
- identification of commercial communications;
- physical address information;
- consent;
- lawful basis;
- prior notice;
- unsubscribe mechanisms;
- objection rights; and
- suppression of opted-out recipients.
12. Geographic Compliance
Beautynavigator may implement jurisdiction-specific communication rules.
The same communication may be permitted in one jurisdiction and restricted in another.
Beautynavigator may therefore apply different marketing rules according to recipient country, recipient type, communication channel or other relevant factors.
13. Complaints and Abuse
Recipients may report unwanted, misleading or abusive communications to Beautynavigator.
Beautynavigator may investigate complaints and may suspend communication privileges while investigating.
Repeated complaints may result in account restrictions or termination.
14. Member Indemnification
Members are responsible for their commercial communications and agree to indemnify Beautynavigator to the extent provided in the Terms of Use for claims arising from their communications, catalogs, products, services or unlawful marketing activity.
15. Policy Changes
Beautynavigator may update this Policy as its services, technologies and legal requirements evolve.
